Terms of Service

These Terms of Service ("Terms") govern your access to and use of the HyGOAT H2Global Screening Tool (the "Service") operated by Ekavikalp Private Limited ("HyGOAT", "we", "us", "our"). By checking the required consent boxes and clicking "Continue" on the legal consent screen, you expressly acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not proceed with the screening.

1. Service Overview

HyGOAT provides the H2Global Screening Tool: a self-service RFNBO compliance screening for international tender bidders. The Service is available without account registration via anonymous sessions.

2. Anonymous Access and Session Data

2.1 Anonymous Sessions

The Service allows you to complete screenings without creating an account. Anonymous sessions are identified by a unique session ID stored in your browser.

2.2 Session Data Retention

• Anonymous screening data is retained for 30 days after last activity
• Session data may be lost if you clear your browser storage

2.3 Screening Reports

• Basic compliance scores and gap analysis are provided free of charge
• Detailed compliance reports require payment via Razorpay
• All prices are displayed before payment, exclusive of 18% GST where applicable
• Payment must be completed before report generation
• We do not store your payment card details

3. Screening Disclaimer

The H2Global Screening Tool provides indicative compliance assessments based entirely on self-reported data. You are solely responsible for the accuracy and completeness of all information you submit.

HyGOAT:

• Does not independently verify, audit, or certify any information you provide
• Does not guarantee tender eligibility, bid success, or certification approval
• Does not provide legal, financial, technical, or regulatory advice
• Is not an accredited certification body under the EU Delegated Acts, H2Global programme rules, or any other regulatory framework

Assessment results are for internal planning and preliminary gap-identification purposes only. Before submitting a tender bid or making material business decisions, you must engage a qualified accredited certification body (such as CertifHy, ISCC, or REDcert) and, where applicable, independent legal counsel.

4. Business Use Only

By using the Service, you represent and warrant that you are accessing this Service for business or commercial purposes only, and not as a consumer. The Service is designed for enterprises, project developers, and professional organisations evaluating RFNBO compliance for hydrogen production projects.

5. User Responsibilities

You are responsible for:

• The accuracy and completeness of all data you provide to the Service
• Ensuring your use of the Service complies with all applicable laws and regulations, including EU RFNBO regulations, H2Global tender requirements, Indian green hydrogen certification standards (GHCI), and data protection laws applicable to your jurisdiction
• Not misrepresenting your organisation's compliance status based on screening results

6. Intellectual Property

Ekavikalp Private Limited owns all right, title, and interest in the Service, including all software, algorithms, scoring models, threshold calculations, benchmark data, report templates, and associated intellectual property.

You are granted a limited, non-exclusive, non-transferable licence to:

• Use the Service for your internal business purposes
• Download and use assessment reports generated for you, solely for internal planning

You may not:

• Copy, reverse-engineer, decompile, or create derivative works of the Service or its underlying models
• Resell, sublicence, or distribute reports or Service outputs to third parties on a commercial basis
• Use Service outputs to train, benchmark, or develop competing AI or compliance screening products

7. Indemnification

You agree to indemnify and hold harmless Ekavikalp Private Limited, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use of or reliance on the Service
• Any inaccuracy in data you submitted to the Service
• Any business decision made based on screening results
• Your violation of these Terms or applicable law

8. Limitation of Liability

To the fullest extent permitted by law, our total aggregate liability to you for any claims arising out of or in connection with the Service — whether in contract, tort (including negligence), breach of statutory duty, or otherwise — shall not exceed the total amount paid by you for the Service in the twelve (12) months preceding the claim.

We will not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunity
• Tender bid failures, certification rejections, or regulatory non-compliance
• Decisions made based on indicative screening results

9. Payment Terms

For paid reports:

• Payments are processed securely via Razorpay, an RBI-regulated payment gateway. Razorpay's privacy policy governs their handling of your payment data: https://razorpay.com/privacy/
• All prices are exclusive of 18% GST where applicable
• Payment must be completed before report generation
• We do not store your payment card details — they are handled entirely by Razorpay
• All sales are final; no payment reversals once a report has been generated

10. Governing Law

These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Jaipur, Rajasthan, India.

11. Changes to Terms

We may modify these Terms from time to time. We will provide notice of material changes by posting updated Terms on our website. Material changes affecting consent-based processing will require you to re-accept the updated Terms via the legal consent screen before continuing to use the Service.
