These Terms of Service ("Terms") govern your access to and use of HyGOAT Screen and related services operated by Ekavikalp Private Limited ("HyGOAT", "we", "us", or "our"). By using HyGOAT Screen, creating or recovering an assessment, submitting a contact request, or purchasing a report, you agree to these Terms and to the Privacy Policy.
If you do not agree, do not use the service.
1. Service Overview
HyGOAT Screen is a public green hydrogen readiness screening service. Its current public assessment workflows are:
- EU RFNBO export readiness
- India GHCI certification gap analysis
H2Global tender-specific screening is not an active public workflow while general supplier application windows are inactive. Historical H2Global records and privately enabled tender reviews may remain available for compatibility and support.
The service may be offered through anonymous public sessions, guest access links, authenticated access, free summary email flows, and paid report tiers.
2. Indicative Output Only
HyGOAT Screen is an indicative screening and readiness tool only. It helps structure information and identify apparent gaps based on the data you submit.
HyGOAT does not:
- certify projects
- act as an accredited verifier, certification body, auditor, consultant, lawyer, engineer, investment adviser, or tender authority
- provide legal, financial, engineering, tax, compliance, procurement, or investment advice
- guarantee RFNBO, H2Global, GHCI, tender, financing, export, offtake, certification-body, or regulator acceptance
All outputs depend on the accuracy, completeness, and context of the information submitted by you.
3. Eligibility and Authority
By using the service, you confirm that:
- you are at least 18 years old
- you are authorised to submit the relevant company, project, contact, and payment information
- you will not submit information that you do not have the right to share
- your use of the service is lawful in your jurisdiction
If you submit information on behalf of a company or other organisation, you represent that you have authority to bind that organisation to these Terms.
4. User Responsibilities
You are responsible for:
- submitting accurate, current, lawful, and relevant information
- reviewing whether the screening output is appropriate for your use case
- obtaining independent professional advice before making formal submissions or material decisions
- keeping guest links, payment links, report links, and dashboard credentials confidential
- ensuring that your internal use of outputs is not misleading
You must not:
- submit unnecessary personal data or sensitive data, including financial account data, identity documents, health data, child data, passwords, secrets, or unrelated third-party personal data
- misrepresent HyGOAT outputs as certification, audit opinion, legal advice, tender approval, regulator acceptance, or guaranteed eligibility
- use the service for unlawful, fraudulent, abusive, scraping, spam, interference, or security-testing activity
- reverse-engineer, copy, resell, sublicense, frame, or exploit the service except as expressly permitted
- upload or submit malicious code, illegal content, infringing content, or data you are not authorised to provide
5. Public Sessions, Guest Access, and Browser Storage
HyGOAT Screen may use browser storage and session identifiers to save public assessment progress, recover a guest session, prevent duplicate submissions, and support deletion or anonymisation requests.
You are responsible for the device and browser you use. Clearing browser storage, using private browsing, switching devices, or using a different browser may affect access to draft or guest assessments.
Guest links and share links may allow access to the related assessment or output. Treat them as confidential and share them only with authorised recipients.
6. Consent and Data Protection Notice
Before submitting a public Screen assessment, you may be asked to confirm acceptance of the Terms, the Privacy Policy, the data-protection notice, and the Screen disclaimer. Your consent record may include the accepted versions, timestamp, method, and jurisdiction context.
Our handling of personal data is described in the Privacy Policy. If you withdraw consent or request deletion/anonymisation, some service functions may no longer be available, and we may retain limited records where required for legal, security, payment, tax, accounting, dispute, or fraud-prevention purposes.
7. Paid Reports and Payments
If you purchase a paid report:
- prices, taxes, currency, and tier details are shown before payment authorisation
- payment is processed by a third-party payment provider
- we do not intentionally store raw card numbers, CVV, bank credentials, or full payment account details
- promo codes, credits, and bypass flows are subject to validity, tier, anti-abuse, and operational rules
- we may cancel or refund an order if a clear pricing, eligibility, technical, or fraud issue is identified before fulfilment
Except where required by law, paid digital outputs are generally non-refundable after delivery, generation, download, email dispatch, or guest access provisioning.
8. Reports, Exports, and Permitted Use
Subject to these Terms, you may use paid reports and downloaded outputs for your internal business review, internal compliance planning, and discussions with your authorised advisers, consultants, auditors, customers, investors, or counterparties.
You must not:
- remove disclaimers from outputs
- present outputs as independent certification or assurance
- use outputs in a misleading way
- publish, resell, or redistribute outputs as a standalone product without written permission
We may restrict or disable data exports for ineligible, incomplete, suspicious, or abuse-prone flows.
9. Contact Requests and Communications
If you submit a contact, consultation, or support request, we may use the information you provide to respond, triage your request, keep operational records, and improve service quality. Do not include unnecessary sensitive or third-party personal data in contact forms.
You may receive transactional communications related to assessments, payments, guest access, deletion/anonymisation, or support requests. Marketing communications, where used, will follow applicable consent and opt-out requirements.
10. Intellectual Property
HyGOAT and its licensors own the service, including software, scoring logic, question flows, report structures, templates, documentation, branding, visual design, text, and related materials.
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to use the service and purchased outputs for your internal business purposes.
You retain responsibility for the project data you submit. You grant us the rights needed to host, process, analyse, generate, secure, support, and deliver the service and related outputs.
11. Availability and Changes
We may modify, suspend, or discontinue parts of the service, including public sessions, pricing, payment providers, report formats, assessment questions, supported schemes, guest access, and data-retention settings.
We may also correct or update outputs, fix errors, restrict access, or refuse service where necessary for security, compliance, legal, payment, fraud, abuse, or operational reasons.
12. No Warranty
The service is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We do not warrant that:
- the service will be uninterrupted, secure, error-free, or always available
- outputs will be complete, correct, current, or fit for a specific commercial purpose
- the service will satisfy regulatory, certification, tender, finance, export, customer, or audit requirements for your project
You remain responsible for independent review and professional advice.
13. Limitation of Liability
To the maximum extent permitted by law, HyGOAT will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profit, revenue, business opportunity, goodwill, data, certification opportunity, tender outcome, financing, offtake, or regulatory approval arising from your use of the service.
If liability cannot be excluded, our aggregate liability for paid services will not exceed the amount you paid us for the relevant service in the 12 months preceding the claim.
14. Indemnity
You agree to indemnify and hold harmless HyGOAT, its affiliates, directors, officers, employees, and agents from claims, losses, liabilities, damages, or expenses arising from:
- your misuse of the service
- your submitted data, instructions, or representations
- your breach of these Terms, the Privacy Policy, or applicable law
- your misleading use or onward sharing of outputs
- your infringement of third-party rights
15. Privacy
Your use of the service is also governed by our Privacy Policy, available at /privacy-policy.
16. Governing Law
These Terms are governed by the laws of India. Subject to applicable law, disputes will be subject to the courts of Jaipur, Rajasthan, India.
17. Changes to These Terms
We may update these Terms from time to time. Continued use of the service after updated Terms become effective constitutes acceptance of the updated Terms. If a material change affects a paid or active workflow, we may provide additional notice where operationally appropriate.
