Terms of Service

These Terms of Service ("Terms") govern your access to and use of HyGOAT Screen and related services operated by Ekavikalp Private Limited ("HyGOAT", "we", "us", or "our"). By using the service, you agree to these Terms. If you do not agree, do not use the service.

1. Service Overview

HyGOAT Screen is a public green hydrogen readiness screening service. It allows users to evaluate project readiness across supported pathways such as India GHCI, EU RFNBO, or a combined dual pathway. The service may be offered through anonymous sessions, authenticated access, and paid report tiers.

2. Nature of the Service

HyGOAT Screen is an indicative screening tool only.

HyGOAT:

• does not certify projects
• does not act as an accredited verifier or certification body
• does not provide legal, financial, engineering, or investment advice
• does not guarantee tender eligibility, certification success, or commercial outcomes

All outputs depend on the information submitted by the user.

3. User Access

You may use parts of the service without creating an account. Certain paid, saved, or dashboard-linked features may require account access. You are responsible for maintaining the confidentiality of your account access details where accounts are used.

4. User Responsibilities

You are responsible for:

• submitting accurate and lawful information
• using the service only for legitimate internal business purposes
• reviewing whether the screening outputs are appropriate for your use case
• obtaining independent professional advice before making formal submissions or material decisions

You must not:

• misuse the service, including through abuse, scraping, interference, or fraud
• misrepresent HyGOAT outputs as formal certification or verification
• attempt to reverse-engineer or unlawfully copy the service or its proprietary materials

5. Paid Reports and Payments

If you purchase a paid report:

• payment is processed by our payment provider
• prices and taxes are shown before you authorize payment
• promo codes, where offered, are subject to validity, tier, and anti-abuse rules
• we may cancel and refund an order if a clear pricing or technical error is identified before fulfillment

Except where required by law, paid digital outputs are generally non-refundable after delivery.

6. Intellectual Property

HyGOAT and its licensors own the service, including the software, report structures, scoring logic, branding, and related materials. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the service for your internal business purposes.

7. No Warranty

The service is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We do not warrant that:

• the service will be uninterrupted or error-free
• the outputs will be complete, correct, or fit for a specific commercial purpose
• the service will satisfy regulatory or certification requirements for your project

8. Limitation of Liability

To the maximum extent permitted by law, HyGOAT will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profit, revenue, business opportunity, or goodwill arising from your use of the service.

If liability cannot be excluded, our aggregate liability for paid services will not exceed the amount you paid us for the relevant service in the 12 months preceding the claim.

9. Indemnity

You agree to indemnify and hold harmless HyGOAT, its affiliates, directors, officers, employees, and agents from claims, losses, or expenses arising from:

• your misuse of the service
• your submitted data or representations
• your breach of these Terms or applicable law

10. Privacy

Your use of the service is also governed by our Privacy Policy.

11. Governing Law

These Terms are governed by the laws of India. Subject to applicable law, disputes will be subject to the courts of Jaipur, Rajasthan, India.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the service after updated Terms become effective constitutes acceptance of the updated Terms.
